O Livro

a) por um lado, facilitar ao leitor a comparação entre o texto do Decreto-Lei n.º 69/2000 e o respectivo comentário e entre este e outra legislação comunitária, nacional e internacional relevante;

A utilização do CD-ROM possibilitará:

The book

The book is divided in two large parts. There is the English version between pages 3 and 153 and the Portuguese version from page 3 to 159 (inverted pages).
Each of these parts contains two sections:
a) The first section, in the full height of the book, includes the initial thoughts (the current introduction, some explanatory notes, the list of abbreviations used, a table of contents and a general index of the book);
b) The second section, the main part of the work, contains the EIA legislation (National, European and International) and other legal diplomas directly related to the EIA regime, in the top part, and the authors’ commentaries to Decree Law no. 69/2000 as well as to the national implementation of the European directive, in the bottom part; in this part you also find some tables concerning the time-frames established in Decree Law no. 69/2000, as well as the various phases of the procedure, the interveners involved in each of these phases and the documents and decisions that result from them.
The consulting of the comments in the bottom part of the second section and its relation to the legal texts is made easier by the sequential numbering of the notes and by calling the readers’ attention to it in the text of the law, as well as by the indication, before each note, of the article to which it refers (and the respective number and/or line, when this is the case).
Two fundamental ideas guided the writing of the book, with the above-mentioned characteristics:
a) on the one hand, to make it simple for the reader to compare the text of Decree Law no. 69/2000 with its commentary and to compare this with the relevant European, National and International legislation;
b) on the other hand, to emphasize the norms of the European directives whose direct effect allows their invocation to integrate the lacunae or to help the interpreting of the national law, thus overcoming some faults in the implementation of the national legislation of the EIA.

The CD-ROM

Besides the original form of the book, which makes it simple to cross-check the legal documents, the European directives and the authors’ commentaries, many of the functions will only be available on the CD-ROM version. Therefore, we strongly recommend you to consult it. Using the CD-ROM will enable:
a) an automatic search for subjects by introducing key-words;
b) the interactive consultation of the legislation made easier by intra and extra legal references;
c) a subject-oriented study, made possible by the hypertext references in the legal diplomas and in the commentary;
d) a critical assessment of the national law allowed by the interactive and bi-directional comparison between the national norms and the corresponding norms in European directives;
e) a quick view of the main phases of the procedure, schemes, time-frames and competent bodies in the EIA procedure;
f) direct access to the main legislation and jurisprudence relevant to the EIA procedure;
g) and, of course, the printing of all the available legislation and jurisprudence.
